The last months of activity by the previous SEC regime led by Chair Gary Gensler resulted in a record number of cases and a flurry of settlements. With that, the acting SEC Chair now has a stack of enforcement matters to consider. Interviewed for the Financial Planning story, FrontLine Compliance’s Founder and President Amy Lynch does not expect the SEC’s current leadership to move quickly to drop any pending enforcement actions. She comments that the tendency under an acting chair is to make as few changes as possible until a full-time appointee takes over, Once the new Chair is in place, Ms. Lynch adds, the incoming SEC will fully vet the current cases to determine those that they will want to push forward, and which ones they will seek settlements or no longer pursue. Cases where investor harm is not clear may be dropped, whereas fraud cases would likely remain a priority.
