Private funds to have bigger voice with the SEC (FundFire)

The SEC, under its acting chair, has wasted no time in delaying or disrupting new rules implemented by the prior SEC administration. The new disclosure rule for short sales has been delayed, as have the new requirements for filing amended Form PF disclosures. Further, there has been a stated commitment to end what has been deemed “regulation by enforcement.” With the lead quote in the story, Amy Lynch, FrontLine Compliance’s Founder and President, states that the evolving regulatory environment means the voice of private fund managers will be taken into consideration and the industry will now be heard. While the new tone of regulation has emboldened hedge funds and other types of private funds, it does not mean that regulation is going away, and the traditional oversight function of the SEC through examinations and resulting enforcement actions is unlikely to change.
