As the SEC’s new regime indicates a shifting stance on its enforcement priorities for the crypto industry, it will also act as a key driver in the development of the expected crypto regulatory framework. The SEC recently dropped its case against Coinbase, and FrontLine’s Founder and President Amy Lynch believes most cases related to other unregistered crypto exchanges will also be dropped. If the SEC settles its case against Ripple and its digital token, that may prove to be another step toward formulating regulation where theories that tokens are unregistered securities may change. While Ms. Lynch sees the SEC’s pursuit of crypto fraud cases continuing, new views on crypto by the SEC may lead to definitions for when digital assets act as securities and when they are commodities. This would, according to Ms. Lynch, be the determining factor in how regulation proceeds, including the type of regulatory oversight and who would be responsible for it.
