With exams back on, Amy Lynch advises firms to stay off the SEC’s radar (Hedge Fund Alert)

The SEC is back to work and that means its regulatory agenda and examinations will be moving forward again. In exclusive comments featured in Hedge Fund Alert, Amy Lynch, FrontLine’s President and Founder, discusses the significance of the SEC shutdown as well as the expectations for regulation of the industry. Ms. Lynch previously recommended that firms keep their compliance on track during the shutdown and their exam material productions and regulatory filings up to date to avoid a “heavy lift” later. Now with the SEC back to full capacity, she is reminding firms about the upcoming compliance deadlines for rule changes under Reg S-P. Additionally, while the Paul Atkins-led SEC may be advocating a pro-business stance, Ms. Lynch advises compliance departments to be wary of relaxing internal requirements and policies. The surge by firms to open private markets to retail investors is an area she sees as a potential trouble spot for firms, since the SEC will want to know how this is being done and if it is in the best interest of the client.
